PRACTICE
BRAD BAGSHAW handles civil litigation of all types. Some of
the legal areas he has worked in are described below:
PUBLIC INTEREST LITIGATION
Mr. Bagshaw was lead trial counsel for eight same-sex couples in their
quest for marriage rights in Anderson v. King County. i He
was lead counsel in the trial court and Supreme Court for a group of political
and civic leaders in their efforts to force a revote on Sound Transit’s
$2.4 billion light rail project. ii
FISHERMEN’S WAGES AND DISCRIMINATION
Mr. Bagshaw and his law partner Scott Collins have prosecuted
many class action wage claims for the crews of fishing and fish processing
vessels. iii Recently,
they successfully obtained a $5.3 million judgment for 12 crab fishermen
whose wages were willfully withheld. iv
Messrs. Bagshaw and Collins have also pursued claims of unlawful race
and national origin discrimination for the working men and women of America’s
Seattle-based offshore fishing fleet. They have successfully obtained
relief for 83 seamen who claimed that their Japanese employer gave
preferential treatment to their Japanese crewmates; for 10 factory trawler
officers and sailors who claimed that their Norwegian employer gave
preferential treatment to their Norwegian crewmates; and for 18 Vietnamese
seamen who claimed that they were discriminated against based on their
national origin. v
AVIATION
An avid pilot and active flight instructor, Mr. Bagshaw handles aviation
personal injury cases and disputes concerning pilots that arise under the
Federal Aviation Regulations.
Mr. Bagshaw successfully concluded a lawsuit against an airport on
behalf of a pilot who was seriously injured and the estates of his two
passengers who died when their aircraft struck a tree on a night approach
into the airport. vi Mr. Bagshaw
successfully prosecuted the claims against the airport on the theory that
the airport should have taken steps to make the approach safer.
OTHER CIVIL LITIGATION
Mr. Bagshaw has represented his clients in a wide variety of civil
litigation matters, including civil rights claims, fraud and racketeering
claims, claims of mass tort and breach of contract, salvage claims, will
contests and real estate disputes.
SABBATICAL
Mr. Bagshaw is sailing the Pacific on a year long sabbatical. He will return to the practice of law in
September 2008.
